IDEA Complaint Decision 01-045

On May 25, 2001, the Department of Public Instruction received a complaint under state and federal special education law from XXXXX against Milwaukee Public Schools. The issues are whether the district properly responded to parent requests on May 12 and June 1, 2000, to have individualized education program (IEP) team meetings; included services in the December 7, 2000, IEP to meet the childs educational needs related to transportation; and properly conducted an IEP team meeting on December 7, 2000, to review, and, as appropriate, revise the child's IEP.

IDEA Complaint Decision 01-043

On May 25, 2001, the Department of Public Instruction received a complaint under state and federal special education law from XXXXX against Milwaukee Public Schools (MPS). The issue in this complaint is whether the district failed to dispense a childs medication, as required by the childs individualized education program (IEP). This is the departments decision for that complaint. Department staff repeatedly requested materials from the district responding to this complaint, but as of July 19 the district had not sent materials.

IDEA Complaint Decision 01-042

This responds to a letter, dated May 18, 2001, to the department from XXXXX which alleges that Milwaukee Public Schools failed to have an agency representative knowledgeable about and authorized to commit district resources to meet the needs of a child with a disability at an individualized education program (IEP) team meeting held on May 16, 2001. A copy of the letter is enclosed. The department has determined that the circumstances of this allegation are the same as those already identified as an area of systemic noncompliance in onsite monitoring activities in the district.

IDEA Complaint Decision 01-040

On May 17, 2001, the Department of Public Instruction received a complaint under state and federal special education law from XXXXX against Milwaukee Public Schools. The issues in the complaint are whether the district, during the 2000-2001 school year, failed to provide an English class and an anger management program as required by the childs IEP and improperly removed the child from school for more than 10 days. This is the departments decision regarding that complaint.

IDEA Complaint Decision 01-035

On April 25, 2001, the Department of Public Instruction received a complaint under state and federal special education law from XXXXX against the Milwaukee Public Schools (MPS). The issue in this complaint is whether the district, between June and August, 2000, failed to provide the related services of transportation and a special education aide as extended school year services, consistent with a childs individualized education program (IEP). This is the departments decision for that complaint.

IDEA Complaint Decision 01-054

On June 27, 2001, a special education complaint was filed with the Department of Public Instruction by XXXXX against Milwaukee Public Schools. A copy of the letter is enclosed. The issue is whether the district failed to properly determine an educational placement for a child with a disability. This is the departments decision regarding that complaint.
