Intended Audience: Superintendents, Directors of Special Education, Business Office Staff, and CESA staff.
In the IDEA regulations, districts are responsible for calculating and expending a proportionate share of their flow-through and preschool allocations on parentally-placed private school children who are eligible for special education services. The entire amount that must be set-aside must be spent on equitable services.
The calculation that must be used to determine an LEAs equitable services set-aside is directed by the regulations. The regulations are also clear that IDEA funds must be used before local funds are used for equitable services.
Equitable services will be a focus of DPI's external monitoring of LEAs. Not implementing these requirements will result in non-compliance and may lead to a repayment of funds.
