IDEA Complaint Decision 03-029

On June 23, 2003, the Department of Public Instruction received a complaint under state and federal special education law from XXXXX against the Genoa City J2 School District. This is the department's decision regarding that complaint. The issue is whether the district, beginning in May 2003, implemented a student's individualized education program (IEP) which offers him the option of a modified school schedule.

The parent maintains that between May 16, 2003, and June 10, 2003, the district counted her child as absent from school for ten half-days after an April 15, 2003, IEP team meeting was conducted permitting a modified school schedule of A.M. classes and P.M. home-study. The district implemented the student's IEP by providing a modified schedule. In a June 30, 3003, letter to the department, the district acknowledged that it committed a clerical error in counting the student absent from school. The student's absences between May 16, 2003, and June 10, 2003, listed on the student's report card have been removed and a new report card has been issued. The district will meet with the appropriate personnel, including special education staff and the attendance clerk, to ensure that students are not counted as absent from school when their IEPs call for a modified schedule.
