IDEA Complaint Decision 01-042

This responds to a letter, dated May 18, 2001, to the department from XXXXX which alleges that Milwaukee Public Schools failed to have an agency representative knowledgeable about and authorized to commit district resources to meet the needs of a child with a disability at an individualized education program (IEP) team meeting held on May 16, 2001. A copy of the letter is enclosed. The department has determined that the circumstances of this allegation are the same as those already identified as an area of systemic noncompliance in onsite monitoring activities in the district.

The district has been directed to address this area of noncompliance and will be submitting verification of its actions to the department. The department conducted a review of this issue during its onsite monitoring visit in May 2001. Following completion of the activities related to that review, the department will determine the measures required of the district to ensure that corrective activities effectively address this area of noncompliance.

With regard to the child named in the enclosed letter, the district is directed to contact the parent promptly to determine whether he wants the district to conduct an IEP team meeting regarding his child's education. The district is directed to report the status of this matter to the department within 10 days of the date of this letter. The department will determine whether further action by the district is necessary to resolve this matter for this student.
